COLLECTIVE BARGAINING AGREEMENT BETWEEN MEMBERS OF UGANDA FLOWER EXPORTERS ASSOCIATION LTD (UFEA) (HEREIN AFTER REFERRED TO AS "EMPLOYERS") WHO ARE SIGNATORIES TO THE RECOGNITION AND PROCEDURAL AGREEMENT AND UGANDA HORTICULTURAL ALLIED WORKERS UNION (UHAWU)( HEREIN AFTER REFERRED TO AS THE "UNION") FOR AND ON BEHALF OF WORKERS IN MATTERS OF WAGES AND SALARIES

1. PREAMBLE

An agreement made on this 08 day of June 2011 between members of UFEA

And

The Uganda Horticultural and Allied Workers Union Whereas:

In entering this agreement both the Union and Employers appreciate that it is in their interest to have productive, continuous and reliable employment and good service delivery to all concerned.

The Employer and the Union hereto are desirous to maintaining good and normal working relations in the flower industry, by introducing better arrangement for wages/salaries

The Employer and the Union having already signed the Collective Bargaining Agreement for terms and condition of service and now wish to sign the Collective Bargaining Agreement for wages and salaries (Phase II); the parties, NOW DO HEREBY MUTUALLY AGREE AS FOLLOWS:

2. SCOPE

In this Phase II of the Collective Bargaining Agreement only wages and salaries increment has been considered the most urgent issue to both concerned. The rest of the items will be considered for future negotiations.

3. SALARIES AND WAGES

It was agreed that the following salaries and wages be agreed on and implemented immediately:

(a) Minimum wage - shs. 2,300 per day for employee of farms beyond lOO kms from Kampala and shs. 2,500 for employees of farms within lOO kms from Kampala

(b) Salaries and wages increase - employees of the lowest (general) workers category currently earning above the minimum wage should have an increase of 10%.

4. IMPLEMENTATION

The implementation date for the year 2011 will be 1st April, 2011 -31 March 2012, and in future, wages and salaries shall be increased with effect from 1st April starting from 2012 after fresh negotiations are concluded with the Union. Wages and salaries shall be reviewed every year and negotiations shall take place between January and March. All proven salary increases given after 1st September 2010 shall be recognized to be part of this raise.

5. SERVICE CHARGE/FEE

It was agreed that the employees in the Unionisable grades who opt not to formally join the Union, but continue enjoying the fruits of its activities just like the registered members do, will pay to the Union a one off service charge equal to 10% of one's basic salary only with a written consent (voluntary) as is done with Unionized members.

All companies shall meet with the Union at UFEA and harmonize best practices within a period of three (3) months.
