This agreement made this28th day of June 2000

BETWEEN

CITY COUNCIL OF KAMPALA of P.O. Box 7010, Kampala (hereinafter referred to as the ''COUNCIL" ) of the one part;

AND

UGANDA PUBLIC EMPLOYEES UNION of P.O. Box 7060, Kampala (hereinafter referred to as the ''UNION") of the other part;

WITNESSETH AS FOLLOWS:

WHEREAS

The Council and the Union are cognisant of the relevant laws and policies of the state and of either party.

AND WHEREAS

The council and the Union are committed to safeguard and protect workers rights and to generally promote the economic and social aspects of the workers.

AND WHEREAS

Both parties are dedicated to general development of Kampala City Council and aware of cardinal obligations of delivering services to City Council of Kampala dwellers.

AND WHEREAS

This agreement is made in cognisance of the recognition and procedural agreement between the parties to this agreement

AND WHEREAS

This agreement is made in cognisance of the collective bargaining agreement between the parties to this agreement dated 20th October, 1999.

AND WHEREAS'

Both parties bind themselves and their successors to the provisions of this

agreement for the achievement of the foregoing objectives.

NOW THIS AGREEMENT WITNESSETH AS HEREUNDER:

1.COMMITMENTS

(i)

Both parties to this agreement are committed to jointly undertake appropriate measures to review and rationalise Council departments and functions to facilitate improvement of service delivery and the operations of Council business.

(ii)

The parties to this agreement undertake to conduct comprehensive and strategic manpower planning policy that recognises and draws clear and favourable programmes to manage personnel exit.

2. APPLICATION

(i)

The provisions of this Agreement shall only be enjoyed by members and shall apply only to subscribing members of

Union

(ii)

Council shall while managing the personnel exit from service priority to those who wish to retire voluntarily.

(iii)

Council employees who voluntarily retire shall be paid benefits as per this agreement.

3. REDUNDANCY

(i)

The principle of “First in” “Last out" shall apply to the Union members. The Union officials shall be "Last out". For avoidance of doubt this principle shall apply where issues of performance, age, qualifications, health and other stated issues have been put into consideration.

(ii)

Termination shall only be effective when accruing terminal benefits/package and other outstanding dues are duly paid.

(iii)

The Union leadership shall be involved in the implementation of redundancy management measures. For avoidance of doubt, the Union shall particularly be involved in the verification of the lists and benefits of those to be paid in accordance with this agreement.

4. TERMINAL BENEFITS

Council employees who have been laid off or have voluntarily retired under this agreement shall be paid terminal benefits as agreed hereunder.

(i) Notice:-

Three (03) month’s Gross pay in lieu of

notice

(ii) Annual leave:-

One (01) month’s Gross pay in lieu of leave

not taken.

(iii) Severance pay:-

Two (02) month’s current Gross pay

obtaining on the payroll multiplied by the number of years worked to the maximum of twenty (20) years of service.

(iv) Transport:-

(a) Shs. 3500/ per kilometre — from

Employment Station to Employees home District headquarters. Then;

(b) A flat rate of shs. 200,000/- from the Employees home district Headquarters to the rural home village (Final destination). 5. CERTIFICATE OF SERVICE

A certificate of Service stating the period an employee has served in Council and any other relevant remarks shall be given to Council employees on leaving Council service.

6. GENERAL PRINCIPLES

When the Council is recruiting labour, former employees who have been discharged as redundant or who have voluntarily retired shall be eligible to apply for re-employment provided they have the required quialifications for the vacancies to be filled and have clean record.

7. REVIEW OF THIS AGREEMENT

This agreement shall be reviewed once every two financial years. Except where both parties agree for a lesser period.

8. DURATION OF THE AGREEMENT

This agreement shall apply to all unionised employees of Council and shall be a legally binding document to both parties thereto

9. EFFECTIVE DATE OF THIS AGREEMENT

The effective date of this agreement shall be 28th day of June, 2000.

10. THE COLLECTIVE BARGAINING AGREEMENT ON MANAGEMENT OF PERSONNEL EXIT FROM SERVICES

This collective bargaining agreement on Management of Personnel

exit from Council is hereby entered into in good faith and for the benefit of all parties hereto.

11.

The Collective Bargaining Agreement between Council ail the Union on terminal benefits made in 1997 is hereby repealed.
